Acceptable Use Policy

1. Purpose and Application

This Acceptable Use Policy (“Policy”) sets out the conduct that is prohibited on the BuildFair platform (the “Platform”). It forms part of, and is incorporated into, our Terms of Use. A breach of this Policy is a breach of the Terms of Use. This Policy applies to every user of the Platform, including builders, owners, subcontractors, and suppliers, and to anyone acting on a user’s behalf.

BuildFair moves real money between real businesses. The rules below exist to protect every party on a project, and we enforce them.

2. Financial Crime

You must not use the Platform to:

  • launder money or otherwise deal with the proceeds of crime;
  • finance terrorism or sanctioned persons or entities;
  • structure payments to avoid detection, monitoring, or reporting thresholds (for example, splitting a payment into multiple smaller payouts to the same beneficiary);
  • move funds through a project account for any purpose other than the genuine construction project it belongs to; or
  • evade tax or assist any other person to evade tax.

The Platform monitors payment patterns automatically, including velocity and structuring patterns, and flagged matters are reviewed by our team. Suspected financial crime may be reported to regulators and law enforcement.

3. False Documents and Payment Claims

You must not:

  • submit false, inflated, or fabricated invoices, progress claims, quotes, or variations;
  • upload forged, altered, or misleading documents, signatures, or certificates;
  • submit evidence photos that misrepresent the state, location, or timing of works (including stripping or falsifying photo metadata for that purpose);
  • misrepresent the completion status of works, the rectification of defects, or an entitlement to payment; or
  • collude with another user to approve claims that both parties know to be false.

4. Card Payment Misuse

Where card payments are available, they exist so that a genuine payer can pay a genuine payee for genuine work or materials. You must not:

  • use the card rail to pay yourself or a related entity in order to convert card credit into cash or bank funds;
  • process a card payment for a transaction that is not a genuine project payment;
  • use a card you are not authorised to use, or initiate a payment you know is likely to be disputed or charged back; or
  • attempt to avoid, manipulate, or misstate the disclosed card surcharge.

5. Security and Platform Integrity

You must not:

  • attempt to circumvent, disable, probe, or interfere with any security feature of the Platform, including authentication, multi-factor authentication, payment holds, freezes, approval controls, or tenant isolation;
  • access, or attempt to access, data belonging to another organisation or project you are not a party to;
  • share your account credentials, or use another person’s account;
  • introduce malware, or conduct denial-of-service, brute force, credential-stuffing, or injection attacks;
  • reverse engineer, decompile, or copy the Platform’s software except as permitted by law; or
  • test the Platform’s security without our prior written authorisation. If you believe you have found a vulnerability, report it to us as described in section 10 and do not exploit it.

6. Automated Access and Scraping

You must not use bots, scrapers, or other automated means to access the Platform, harvest data from it, or submit transactions on it, except through interfaces we expressly provide for that purpose. Rate limits and bot protections apply across the Platform, and attempting to evade them is a breach of this Policy.

7. Content Standards

Content you submit to the Platform (including messages, project records, photos, and documents) must not:

  • be unlawful, defamatory, harassing, or threatening;
  • infringe any person’s intellectual property, privacy, or confidentiality rights;
  • contain another person’s personal information without a lawful basis to share it; or
  • be deliberately misleading in a way that could cause another user to act to their detriment.

8. Impersonation and Misrepresentation

You must not:

  • impersonate any person or entity, including another Platform user, a BuildFair employee, or a regulator;
  • misrepresent your identity, licensing, insurance, qualifications, or authority to act for a business;
  • register using another person’s identity documents or business details; or
  • create multiple accounts to evade a suspension, freeze, or verification failure.

9. Enforcement

Where we reasonably believe this Policy has been breached, we may take any of the following actions, depending on severity:

  • issue a warning and require corrective action;
  • remove or restrict access to content, features, or payment rails;
  • apply a protective freeze to affected project accounts while we investigate (see the Terms of Use for how freezes work);
  • suspend or terminate your account; and
  • report the conduct to regulators, law enforcement, or our banking and card partners, and preserve records as evidence.

Enforcement actions are recorded in the Platform’s audit trail. Where it is lawful and safe to do so, we will tell you what action we have taken and why, and give you an opportunity to respond.

10. Reporting Violations

If you become aware of conduct that may breach this Policy, or you believe you have found a security vulnerability, report it to us at support@buildfair.com.au. We take reports seriously, investigate them, and do not penalise good-faith reporting.

11. Changes to This Policy

We may update this Policy from time to time. We will notify you of material changes by posting the updated Policy on the Platform and, where appropriate, by email. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Policy.
